Dame Ada M. Mills, widow of the late John J. Redpath, Esq.

ON THIS DAY the twenty-fourth of December in the year of our Lord, one thousand eight hundred and ninety-seven.

BEFORE CHARLES CUSHING and ROBERT H. BARRON the undersigned Notaries Public, for the Province of Quebec residing and practising in the City of Montreal.

PERSONALLY APPEARED.

DAME ADA MARIA MILLS of the said City of Montreal, widow of the late John James Redpath deceased, in his lifetime of the same place, Esquire.

WHO being of sound and disposing mind, memory, judgment and understanding hath requested us the said Notaries to write down and receive in due form of law her Last Will and Testament which she declared in manner and form following, that is to say:

I desire that all my just debts, funeral and testamentary expenses be paid by my Executors hereinafter named as soon as possible after my death.

I give, devise and bequeath to my dear children, Amy Redpath, Peter Whiteford Redpath, John Reginald Redpath, Harold Mills Redpath and Jocelyn Clifford Redpath the whole of my property, real and personal, movable and immovable, moneys, stocks, funds, securities for money and effects generally whatsoever of which I am possessed or to which I may hereafter be entitled without any exception or reserve hereby constituting my said children my sole universal legatees and devisees equally share and share alike and I desire my said children to make such division among themselves of my furniture, objets de vertu, jewellery, trinkets &c. as they may mutually agree upon.

I desire that the share that may devolve upon my daughter shall not be liable for the debts or obligations of any husband nor enter into any community of property but shall be held used and enjoyed by her as though she had remained single.

The share of any child who may predecease me shall go to his or her lawful issue and failing issue shall be divided equally among my surviving children and their lawful issue by roots.

Inasmuch as these bequests are meant for the maintenance and alimentary support of my said legatees whether children or grandchildren I expressly exempt the same and each of them from seizure for debt or otherwise hereby expressly declaring each and every bequest by me made insaisissable.

I appoint my said children Amy, Peter Whiteford, John Reginald, Harold Mills and Jocelyn Clifford and the survivors of them Executors of this my Will hereby continuing their powers as such beyond the year and day limited by law and authorising them to sell and dispose of immovable as well as movable property and stocks for such consideration and upon such terms and conditions as they may think best in the interest of my Estate to receive the consideration price and grant discharges therefore.

In the event of a different of opinion arising between my said Executors the opinion of the majority shall prevail and any husband of my said daughter shall not have any place as Executor but my said daughter may on all occasions act as an executor without his authority or intervention.

I revoke all Wills and Testaments I may have heretofore made and declare the present to be my only true Last Will and Testament.

The present Will was thus declared by the said Testatrix to us said Notaries and by me Charles Cushing one of said Notaries the other being present read to the said Testatrix who declared to understand the same and to persist therein as being her true Last Will and Testament.

DONE AND PASSED at the said City of Montreal at the residence of the said Testatrix No 1065 Sherbrooke Street on the day, month and year first herein written under the number thirty-two thousand three hundred and fourteen and signed by the said Testatrix with and in presence of the said Notaries also hereunto subscribing in her presence and in that of each other after due reading hereof as aforesaid.
