Contract of Marriage
between
John James Redpath Esq
and
Ada Maria Mills

This Indenture made at Putney near London in England, in Duplicate, the nineteenth day of August In the year of Our Lord One thousand eight hundred and sixty seven by and between John James Redpath of the City of Montreal, in the Province of Quebec, in the Dominion of Canada, and now in Putney aforesaid.

of the first part:

–And –

Ada Maria Mills, spinster of the said City of Montreal, and presently in Putney aforesaid.

of the second part:

Whereas a marriage is intended to be shortly had and solemnized, between the said parties and they deem it inexpedient to allow their rights and property in so far as the same are liable to be effected by the said intended marriage to be governed by the laws of the said Province of Quebec.

Now this Indenture Witnesseth: that the said parties have covenanted and agreed and they do hereby covenant and agree; that notwithstanding the laws of the said Province of Quebec there shall not be any community of property, communauté des biens, between the said John James Redpath and Ada Maria Mills and that on the contrary the said John James Redpath shall separately and individually hold and possess all the property real or personal present or future, which he now holds or possesses, or which he may hold or possess or be entitled to hold or possess, at the time of the said intended marriage or which he may acquire or be in anywise entitled to during such marriage either by purchase or descent or in any other manner or way howsoever: the Custom of Paris, Coutume de Paris and every law, usage, or custom of the said Province of Quebec, to the contrary in anywise notwithstanding. And as regards any property, real or personal which the said Ada Maria Mills may now or at any time hereafter hold or possess or be in anywise entitled to either by title of purchase or by gift, descent, or otherwise howsoever, she the said Ada Maria Mills shall also separately and individually hold and possess the same, as fully and effectually to all intents and purposes whatsoever, as if no marriage such as intended were ever celebrated.

And it is hereby lastly agreed that the said John James Redpath shall bear all the household and other expenses of the said intended marriage, including those of the maintenance and education of the children who may be born of such intended marriage
